General Terms and Conditions for orders, delivery, payment, and liability.

General Terms and Conditions (Terms of Service) of TERMOGAS d.o.o.

1. Scope

These General Terms and Conditions apply to all contracts, deliveries, and other services provided by TERMOGAS d.o.o., Balogovec 64, 40306 Macinec, Croatia (hereinafter referred to as the “Seller”), to its customers (hereinafter referred to as the “Customer”), unless otherwise agreed in writing.

2. Offers and conclusion of contract

  1. All offers made by the Seller are non-binding and subject to change.
  2. The purchase contract is concluded only upon the Seller’s written order confirmation or upon delivery of the goods.

3. Prices and payment terms

  1. All prices are stated in Euro and include the applicable statutory value added tax.
  2. Payments are due immediately upon invoicing without deduction. Accepted payment methods include bank transfer, credit card, and other payment methods offered on the website.
  3. If the Customer is in default of payment, the Seller is entitled to charge default interest at a rate of 5% above the applicable base interest rate.

4. Delivery and shipping

  1. Delivery shall be made to the address provided by the Customer within Germany and Austria.
  2. The standard delivery time is 3–5 business days. Express deliveries are made within one business day.
  3. Shipping is carried out by GLS. Shipping costs are as follows:
    • Free standard shipping (3–7 business days) for orders over €50
    • Standard shipping (3–7 business days) for €8

5. Retention of title

  1. The goods remain the property of the Seller until full payment has been made.
  2. The Customer is obliged to treat goods subject to retention of title with care and may resell them only in the ordinary course of business.

6. Right of withdrawal

  1. The Customer has the right to withdraw from the contract within 14 days without giving any reason.
  2. The withdrawal must be submitted in writing to the Seller’s business address.

7. Warranty and liability

  1. The statutory warranty rights shall apply.
  2. The Seller is liable only for intent and gross negligence.

8. Data protection

  1. The Customer’s personal data shall be processed exclusively for the handling of the order and shall not be passed on to third parties unless necessary for fulfillment of the contract or required by law.

9. Applicable law and jurisdiction

  1. The law of the Republic of Croatia shall apply, excluding the UN Convention on Contracts for the International Sale of Goods.
  2. The place of jurisdiction for all disputes arising from this contract is the competent court in Croatia.

10. Final provisions

  1. If individual provisions of these Terms and Conditions are or become invalid, the validity of the remaining provisions shall remain unaffected.
  2. Amendments and supplements to these Terms and Conditions must be made in writing.
